Shipment & Transfer of Risk

All products purchased from Martinez Martinez LLC (“Company”) are deemed accepted by the Client at the time the shipment leaves the Company’s facility. Upon tender of the shipment to the carrier and issuance of a tracking number, all risk of loss, damage, delay, or theft transfers to the Client, regardless of shipping method or carrier selected.

Carrier Responsibility

Martinez Martinez LLC is not responsible for carrier delays, misdeliveries, lost packages, or damage occurring in transit once the shipment has been transferred to the carrier. Any claims related to carrier performance must be directed to the carrier by the Client unless shipment insurance has been purchased as outlined below.

Optional Shipping Insurance

Shipping insurance is not included unless expressly requested in writing by the Client and paid for in full prior to shipment.

• If shipping insurance is purchased through Martinez Martinez LLC, the Company will assume limited responsibility for replacement of products only to the extent covered by the insurance policy and only after the carrier’s claim process is completed.

• Replacement or reimbursement is subject to carrier approval and insurance payout and does not include expedited production, rush fees, or consequential damages.

 

Theft After Delivery

Martinez Martinez LLC is not responsible for theft, loss, or damage occurring after confirmed delivery, including but not limited to theft from porches, mailrooms, front desks, reception areas, or unsecured delivery locations. Once the carrier confirms delivery to the destination address provided by the Client, all responsibility rests solely with the Client.

Incorrect or Incomplete Address

The Client is solely responsible for providing accurate and complete shipping information. Martinez Martinez LLC is not liable for lost, delayed, or misdelivered shipments resulting from incorrect or incomplete addresses supplied by the Client.

No Consequential Damages

Under no circumstances shall Martinez Martinez LLC be liable for indirect, incidental, special, or consequential damages, including lost profits, missed deadlines, or reputational harm arising from shipping issues.

Acceptance of Terms

By placing an order with Martinez Martinez LLC, the Client acknowledges and agrees to these shipping and risk-of-loss terms in full.
